Terms, privacy and payment information

These Terms and Conditions (hereinafter: Terms) govern the relationship between the user of the THOM app (hereinafter: User) and the THOM service provider (hereinafter: Provider). By using the THOM app, the User accepts these Terms in their entirety.
THOM is a mobile application designed for professional drivers that provides information about traffic rules, activity tracking (records), tachograph assistance, GPS tracking, and an AI assistant for questions related to transport and driving.
The app is available to all users without mandatory registration. Unregistered users can use all basic functions, but their data will not be saved between sessions. Registered users (sign-in via Google or Apple account) have access to personalized features and data storage.
The AI Co-Driver uses a token system. Every user receives 5,000 free tokens monthly that are automatically renewed on the 1st of each month. Additional tokens can be purchased within the app — purchased tokens never expire. Tokens have no monetary value and cannot be transferred to another user, exchanged for money, or returned after purchase.
THOM provides information for informational purposes. Although we strive to keep all data accurate and up-to-date, the Provider assumes no responsibility for any inaccuracies. Traffic rules, fines, and tolls may change without prior notice by the competent authorities of individual countries. The User is obligated to verify current regulations before traveling.
The AI Co-Driver provides answers based on available data and artificial intelligence. The answers are informational in nature and do not constitute legal advice. The Provider is not liable for decisions made based on the AI Co-Driver's responses.
The THOM app does not replace the digital tachograph in the vehicle, which is legally required. The activity records in the app serve as an auxiliary tool and have no legal force. The Provider is not liable for fines, damages, or losses arising from the use or inability to use the app.
All content of the THOM app, including but not limited to text, graphics, logos, icons, images, audio and video materials, software, and databases, is the property of the Provider or its licensors and is protected by intellectual property laws.
The User may stop using the app at any time by deleting their account or uninstalling the app. The Provider reserves the right to suspend or terminate access for Users who violate these Terms.
The Provider reserves the right to change these Terms at any time. Users will be notified of significant changes through the app. Continued use of the app after publication of changes is considered acceptance of the new Terms.
These Terms are governed by the law of the European Union and the Republic of Croatia.
